Hvilke personoplysninger behandler vi og hvorfor

Vi behandler dine personoplysninger, når du ansøger et job, som Genitor formidler på vegne af den rekrutterende virksomhed eller myndighed, eller når du opretter en profil i vores CV-database. Vi behandler i den forbindelse de almindelige personoplysninger, som du angiver i dit ansøgningsmateriale og i vores ansøgningsformular, samt oplysninger, som er indsamlet i forbindelse med samtaler og personlighedstests, herunder fx dine kontaktoplysninger, foto, oplysninger om din uddannelse og erfaring, oplysninger om dine private forhold, testmateriale og testvurdering.

Vi behandler endvidere dine personoplysninger, hvis en kandidat opgiver dig som reference. Vi behandler i den forbindelse de almindelige personoplysninger, som vi har fået oplyst om dig, herunder dine kontaktoplysninger og evt. nuværende/tidligere stillingsbetegnelse samt organisation.

Vi behandler endvidere dine personoplysninger, hvis du deltager i et ledelses- eller kompetenceudviklingsforløb hos os. Vi behandler i den forbindelse de almindelige personoplysninger, som du og/eller din arbejdsgiver afgiver i forbindelse med forløbet, herunder fx dine kontaktoplysninger og oplysninger i forbindelse med persontypetests.

Vi behandler dine almindelige personoplysninger i form af cookies, hvis du besøger vores hjemmeside og har givet samtykke hertil.

Hvilket lovgrundlag har vi for at behandle dine personoplysninger

Når vi behandler almindelige personoplysninger om dig, er hjemmelsgrundlaget, at du har givet samtykke til behandlingen, jf. persondataforordningens art. 6, stk. 1, litra a, og/eller at behandlingen er nødvendig for, at du kan forfølge en legitim interesse i at komme i betragtning til stillinger, som Genitor formidler, jf. persondataforordningens art. 6, stk. 1, litra f.

I det omfang vi behandler følsomme personoplysninger om dig, fordi du på eget initiativ har anført disse oplysninger i dit ansøgningsmateriale, som du uploader til os, betragtes dette som et samtykke til, at vi må behandle oplysningerne, jf. persondataforordningens art. 9, stk. 2, litra a.

Når vi behandler dine personoplysninger i forbindelse med cookies, sker dette på baggrund af dit samtykke, jf. persondataforordningens art. 6, stk. 1, litra a.

Vi gør særligt opmærksom på, at du er berettiget til at gøre indsigelse mod vores behandling af dine personoplysninger, når vores behandling af dine personoplysninger er baseret på dit samtykke, og at du altid er berettiget til at trække dit samtykke tilbage. Du kan til enhver tid ændre eller slette dine personoplysninger i vores CV-database på www.genitor.dk.

Hvem videregiver vi dine personoplysninger til

Vi videregiver udelukkende dine personoplysninger, når det er nødvendigt for at behandle din ansøgning, eller hvis det følger af en retlig forpligtelse, som påhviler os som dataansvarlige.

Når du har uploadet dit ansøgningsmateriale til os i forbindelse med en specifik stilling eller i vores CV-database, videregiver vi dine personoplysninger til:

  • Drifts- og softwareleverandører samt andre databehandlere, og
  • Relevante kunder, som søger kandidater, der matcher din profil eller den specifikke kunde, som du har søgt en stilling hos.

Når du er oplistet som reference for en kandidat, videregiver vi dine personoplysninger til:

  •  Drifts- og softwareleverandører samt andre databehandlere.

Når du deltager i et ledelses- eller kompetenceudviklingsforløb hos os, videregiver vi dine personoplysninger til:

  • Drifts- og softwareleverandører samt andre databehandlere,
  • Testudbydere, og
  • Din arbejdsgiver, såfremt dette er relevant, og du har givet samtykke hertil.

Hvornår sletter/anonymiserer vi dine personoplysninger

Hvis du har givet dit samtykke til, at vi må opbevare dine personoplysninger i vores CV-database, sletter vi dit ansøgningsmateriale 2 år efter sidste login i CV-databasen.

Hvis du har søgt en konkret stilling, som Genitor formidler og har været indkaldt til samtale/test, opbevarer vi dine personoplysninger i 2 år efter rekrutteringsforløbets afslutning, såfremt du har givet samtykke hertil eller 6 måneder efter rekrutteringsforløbets afslutning, såfremt du ikke har givet samtykke.

Du kan altid ændre eller slette dine personoplysninger i vores CV-database på www.genitor.dk eller ved at kontakte os på mail: gdpr@genitor.dk.

Hvis du er oplistet som reference for en kandidat, sletter vi dine kontaktoplysninger 2 år efter rekrutteringsforløbets afslutning.

Hvis du har deltaget i et ledelses- eller kompetenceudviklingsforløb hos os, sletter vi dine personoplysninger 2 år efter forløbets afslutning.

Sikkerhedsforanstaltninger

Vi prioriterer persondatasikkerhed meget højt og har stor fokus på, at vi behandler dine personoplysninger i henhold til gældende persondatalovgivning.

For at beskytte dine personoplysninger bedst muligt vurderer vi løbende de risici der kan være forbundet med vores behandling af dine personoplysninger. Vi er især opmærksomme på at beskytte dine personoplysninger mod diskrimination, identitetstyveri, økonomisk tab, tab af omdømme og datafortrolighed.

Vi har vedtaget interne regler om informationssikkerhed, som indeholder instrukser og foranstaltninger, der beskytter dine personoplysninger mod at blive tilintetgjort, gå tabt/ændret og mod uautoriseret offentliggørelse eller utilsigtet adgang.

For at undgå tab af personoplysninger foretager vi løbende backup af vores systemer, ligesom vi anvender kryptering eller andre sikkerhedsforanstaltninger, hvor det er nødvendigt.

Endelig uddanner vi vores medarbejdere i håndtering af personoplysninger.

I tilfælde af sikkerhedsbrud, der indebærer en høj risiko for dine rettigheder, vil vi underrette dig om sikkerhedsbruddet, så hurtigt som det efter omstændighederne er muligt.

Dine rettigheder

Når vi behandler dine personoplysninger, har du en række rettigheder overfor os.

Hvis du har spørgsmål til vores behandling af dine personoplysninger eller ønsker at gøre disse rettigheder gældende overfor os, kan du altid kontakte os, som anført ovenfor under pkt. 1.

Dine rettigheder:

  • Indsigt. Du har ret til at få indsigt i og kopi af de personoplysninger, vi behandler om dig.
  • Berigtigelse. Hvis vi har registreret forkerte oplysninger om dig, har du som udgangspunkt ret til at få sådanne urigtige personoplysninger om dig rettet.
  • Sletning. I særlige tilfælde har du ret til at få slettet de personoplysninger, vi behandler om dig.
  • Begrænsning af behandling. I særlige tilfælde har du ret til at få behandlingen af dine personoplysninger begrænset til opbevaring.
  • Indsigelse. I særlige tilfælde har du ret til at gøre indsigelse mod vores behandling af dine personoplysninger.
  • Dataportabilitet. I særlige tilfælde har du ret til at modtage dine personoplysninger i et struktureret, almindeligt anvendt og maskinlæsbart format samt at få overført disse personoplysninger fra én dataansvarlig til en anden uden hindring.

Du har ret til at indgive en klage til Datatilsynet, hvis du er utilfreds med den måde, vi behandler dine personoplysninger på, men vi håber selvfølgelig, at du vil kontakte os først, så vi forhåbentlig kan finde en løsning.

Which personal data do we process and why?

We process your personal data when you apply for a job mediated by Genitor on behalf of the recruiting company or authority, or when you create a profile in our CV database. We process the general personal data you include in your application material and our application form, as well as data collected from interviews and personality tests, including e.g. your contact information, photo, information about your education and experience, information about your private life, test material and test assessment.

We also process your personal data if a candidate states your name as reference. We process the general personal data we receive about you, including your contact information and current/previous job title and organisation, if any.

We also process your personal data if you participate in a management or skills development course with us. We process the general personal data received from you and/or your employer in connection with the course, for example your contact information and information from personal tests.

We process your general personal data in the form of cookies if you visit our website and have consented hereto. Learn more about our cookie policy: www.genitor.dk/persondatapolitik/.

Which legal basis do we have for processing your personal data?

When we process your general personal data, the legal basis is your consent, cf. article 6(1)(a) of the General Data Protection Regulation (hereinafter “GDPR”), and/or that processing is necessary for you to pursue a legitimate interest in being considered for jobs mediated by Genitor, cf. article 6(1)(f) of the GDPR.

To the extent that we process sensitive personal data about you because you have disclosed this information in application material uploaded to us on your own initiative, this is considered consent for us to process the relevant data, cf. article 9(2)(a) of the GDPR.

When we process your personal data in connection with cookies, this processing is based on your consent, cf. article 6(1)(a) of the GDPR.

Please note, that in some cases you are entitled to object to our processing of your personal data, when this processing is based on your consent, and you are always entitled to withdraw your consent. You are free to change or delete your personal data in our CV database at any time at www.genitor.dk.

To whom is your personal data disclosed?

We only disclose your personal data when necessary to process your application, or if it follows from a legal obligation incumbent on us as data controller.

When you have uploaded your application material concerning a specific position or in our CV database, we disclose your personal data to:

  • Operations and software suppliers and other data processors, and
  • Relevant customers searching for candidates who match your profile or the specific customer with whom you applied for a position.

When you are listed as reference to a candidate, we disclose your personal data to:

  • Operations and software suppliers and other data processors.

When you participate in a management or skills development course with us, we disclose your personal data to:

  • Operations and software suppliers and other data processors,
  • Test providers, and
  • Your employer if relevant and subject to your consent.

When do we delete/depersonalize your personal data?

If you have consented to our storage of your personal data in our CV database, we delete your application material two (2) years after your last login.

If you have applied for a specific position mediated by Genitor and have been interviewed/tested, we store your personal data for two (2) years after the end of the recruitment process, if you have consented hereto, or six (6) months after the end of the recruitment process if you have not consented hereto.

You are free to change or delete your personal data in our CV database at www.genitor.dk at any time or by contacting us by email: gdpr@genitor.dk.

If you are listed as reference to a candidate, we delete your contact information two (2) years after the end of the recruitment process.

If you have participated in a management or skills development course with us, we delete your personal data two (2) years after the end of the recruitment process.

Security measures

Your personal data security is a high priority to us, and our focus is on processing your personal data in compliance with applicable personal data protection law.

To best protect your personal data, we continuously assess the risks that may be associated with our processing of your personal data. We pay particular attention to protecting your personal data against discrimination, identity theft, financial loss, loss of reputation and data confidentiality.

We have adopted internal information security rules, which contain instructions and measures to protect your personal data from being destroyed, lost/altered and against any unauthorized disclosure or unintended access.

To avoid loss of personal data, we continuously back up our systems, and we make use of encryption or other security measures where necessary.

Finally, we train our employees in handling personal data.

In the event of a data breach that involves high risk to your rights, we will notify you of the breach as soon as possible under the given circumstances.

Your rights

When we process your personal data, you have several rights.

If you have any questions regarding our processing of your personal data or if you would like to make use of the above rights, please feel free to contact us any time as described in clause 1 above.

Your rights:

  • Access right. You are entitled to have access to and copies of the personal data, we process about you.
  • Rectification. If we have incorrect personal data about you, you are as a rule entitled to rectification of any such incorrect personal data about you.
  • Deletion. In special cases, you have the right to have the personal data we process about you deleted.
  • Restriction of processing. You have the right to request that processing of your personal data be limited to storage in special cases.
  • Objection. In certain cases, you are entitled to object to our processing of your personal data.
  • Data portability. In certain cases, you are entitled to receive your personal data in a structured, commonly used and machine-readable format and to have such personal data readily transferred from one data controller to another.

Complaint to the Danish Data Protection Agency

You have the right to file a complaint to the Danish Data Protection Agency, if you are dissatisfied with the way in which we process your personal data. However, we obviously hope that you will reach out to us first to find a solution.
